1. Introduction

These Terms of Service ("Terms") govern your use of the website emmaandsophie.com and any purchase you make through it.

The website is operated by Emma & Sophie, a company registered in the Netherlands under registration number 97290688, VAT number NL005260928B40, with its registered office at Goudsbloemstraat 34, 3353 XK Papendrecht, Netherlands ("we", "us", "our").

By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order with us. By placing an order, you confirm that you meet this requirement and that all information you provide is accurate and complete.

3. Products and Availability

We take care to describe and picture our products accurately. However, product images are for illustration only. Colours may appear slightly different depending on your screen settings, and minor variations in finish, texture or measurement can occur between individual items.

All products are subject to availability. We reserve the right to withdraw or amend any product at any time, and to limit the quantity available to any customer.

4. Pricing

All prices are shown in British Pounds (GBP) and include all applicable taxes and duties.

We make every effort to keep pricing accurate. If a pricing error occurs, we reserve the right to cancel any affected order and issue a full refund. We will contact you before doing so.

Prices may change at any time. Changes do not affect orders that have already been confirmed.

5. Orders and Contract Formation

When you place an order, you are making an offer to purchase. You will receive an automatic order confirmation email, which acknowledges receipt of your order but does not constitute acceptance.

A binding contract is formed only when we send you a dispatch confirmation email.

We reserve the right to refuse or cancel any order, including where:

  • The product is out of stock
  • A pricing or product description error has occurred
  • Your payment cannot be authorised
  • We suspect fraudulent activity
  • The order breaches these Terms

If we cancel an order after payment has been taken, you will receive a full refund.

6. Payment

Payment is taken at the point of order. We accept the payment methods displayed at checkout.

All payments are processed by our third-party payment providers over secure, encrypted connections. We do not store or have access to your full card details.

You confirm that any payment method you use belongs to you or that you are authorised to use it.

7. Delivery

Risk in the goods passes to you upon delivery.

8. Returns and Refunds

9. Statutory Rights

Nothing in these Terms limits or excludes your statutory rights as a consumer. Under the Consumer Rights Act 2015, goods supplied to you must be of satisfactory quality, fit for purpose and as described.

All content on this website — including text, images, logos, graphics, page layout and design — is owned by or licensed to Emma & Sophie and is protected by copyright and trade mark law.

Disputes may be brought before the competent courts of the Netherlands or, where you are a consumer resident in the United Kingdom, the courts of the United Kingdom.
